Indianapolis Birth Asphyxia Attorneys
FIGHTING FOR FAMILIES WHEN THE STAKES ARE HIGHEST
Even as unborn babies, we humans require a steady flow of oxygen to survive. If that oxygen supply is interrupted, the damage could be severe, especially if the damage occurs during pregnancy or birthing process. Unborn babies and newborns are especially delicate and are far more susceptible to damage, which is why any break in oxygen or blood flow can result in severe, life-altering damage. The lack of blood and oxygen to the brain, called birth asphyxia, can result in developmental issues, brain damage, and can even be fatal if untreated.
If your child suffered from birth asphyxia, you need to act quickly to protect their rights and their future. Our experienced birth asphyxia lawyers at Wagner Reese have worked with several families affected by birth injuries, and we understand how traumatizing and disheartening this experience can be. What is Birth Asphyxia?
Birth asphyxia occurs when an unborn baby’s brain is deprived of oxygen or blood. This decreased blood flow affects the development and functionality of the brain, and, subsequently, several other organs throughout the body. Because the brain cells need oxygen to work properly, the lack of blood flow may result in a build-up of acids in the cells, which can be damaging.
Milder cases of birth asphyxia, if treated quickly, may result in minor, temporary damage. However, babies who are deprived of oxygen for a more prolonged period of time may suffer brain damage, organ failure, and even death. In many birth asphyxia cases, birth asphyxia will lead to the development of other health conditions.
The side effects of birth asphyxia include:
- Behavioral problems or disorders
- Cerebral Palsy
- Developmental delays
- Difficulty with speech
- Hearing or visual impairments
- Hypoxic ischemic encephalopathy (HIE)
- Learning disabilities
- Motor disorders
- Orthopedic issues
- Seizure disorders
WHO COULD BE LIABLE FOR MY CHILD’S INJURIES?
In short, anyone associated with your child’s treatment, or lack thereof, may be liable for the damages he or she suffered. Most birth injuries are caused by medical negligence which includes doctor negligence, nurse negligence, hospital negligence, defective medical equipment, or other similar issues. To that end, your hospital or medical care facility is most likely liable for your child’s birth injury cases. However, the doctor may also be liable for their negligence or mistakes, and where you can ask for a medical malpractice claim.
Several different problems may lead to birth asphyxia, including:
- Prolonged birth
- Umbilical cord issues (pinched, prolapsed, etc.)
- Hypoxemia affecting the mother
- Placental abruption
- Maternal infection
- Maternal blood pressure issues
- Anemia
- Premature birth
Any of the issues listed above can put the baby at risk of birth asphyxia, which requires immediate attention. The nurse or doctor must monitor mothers for potential issues, and if the symptoms of birth asphyxia are present, they may have the mother shift positions, or they may administer restorative medications, or, in some cases, they may order an emergency C-section to deliver the baby. If, however, the medical staff fails to diagnose, treat, or monitor the mother or unborn baby properly, the consequences can be extensively damaging.
